FDNS Site Visit: Preparation and Response Checklist

When to Use

The US Citizenship and Immigration Services (USCIS), through its Fraud Detection and National Security Directorate (FDNS), regularly conducts administrative and targeted site visits. These visits are on-site inspections designed to verify that petitioners (employers that sponsor foreign workers) and beneficiaries (sponsored employees) are following the terms and conditions of visa petitions that are approved or pending adjudication. Though a site visit and the associated compliance review process are voluntary, petitioners and beneficiaries are strongly encouraged to participate.

Consequently, it is critical for employers to be aware of and prepare for such visits. An organization that employs H-1B, L-1 or other nonimmigrant workers can use this checklist to prepare for a site visit and to ensure that it has a thoughtful, compliant response if FDNS officers come knocking.

The procedure is generally sequential, but some steps may be completed concurrently.
