Summary

  • Employers must begin withholding for child support no later than on the first payday following receipt of a child support withholding order. Payments must be remitted within seven business days after the withholding or payday. Child support cannot exceed a certain percentage of an employee's disposable income. See Child Support Withholding.
  • Employers are required to respond to a garnishment order within 30 days after being served with a summons, and fulfil other responsibilities. South Dakota law limits the amount of disposable earnings that is subject to creditor garnishment. See Creditor Garnishment Withholding.
  • Voluntary wage assignments are not valid in South Dakota unless certain conditions are met. See Voluntary Wage Assignments.
