Webinar: DOL's Proposed Overtime Rule - Get Ready Now to Avoid Pain Later
The US Department of Labor (DOL) has proposed major changes to the Fair Labor Standards Act (FLSA) overtime rules.
If they are finalized (and they’re almost certain to be finalized), the rules will raise the minimum salary for most overtime-exempt employees from $684 per week ($35,568 per year) to $1,059 per week ($55,068 per year) or higher.
If any of your exempt employees are among the estimated 3.4 million exempt workers who are paid less than the new salary threshold, you’ll need to decide whether to:
- Increase their weekly salary to retain their exempt status;
- Reclassify them as nonexempt salaried employees and pay them overtime for any overtime hours worked; or
- Reclassify them as nonexempt, but convert them to hourly employees.
There are pros and cons to each decision, and lots of things to consider. The sooner you start getting ready, the better prepared you'll be to act when the rule is finalized!
