Summary
- Employment in Minnesota is at-will by default. Therefore, when making employment offers, employers should be careful not to inadvertently alter the at-will status. Unless an employer intends to impose conditions on termination, employment offers should make clear that the position is at-will. See Offer Letters.
- Employment offers should set forth any preconditions to employment, such as a successful background check, drug testing, preemployment physical examinations, and the execution of restrictive covenant agreements. See Conditional Offers.
