When to Use
Serving on a jury is an important civic duty. The Jury System Improvements Act and the laws of most states protect the employment status of individuals who serve as jurors. These laws generally prohibit employers from firing or otherwise retaliating against an employee whose absence from work is related to jury service.
Respecting the subpoena power of courts and agencies is also critical to our justice system. Some states require employers to permit employees to take leave to participate in court proceedings as a witness.
An employer should consider implementing a policy to demonstrate its support for employee jury service and to address leave to appear as a witness in response to a subpoena.
