When to Use
An employer that is willing to pay its nonexempt employees at least the minimum wage for all time they spend on call can place restrictions on those employees' on-call time without creating a potential liability under the Fair Labor Standards Act (FLSA).
An employer should consider implementing this policy to establish requirements for employees' paid on-call time and to support compliance with the FLSA and state wage and hour laws.
