Solicitation and Distribution Policy
Author: Jason Habinsky, Haynes & Boone
When to Use
Employers should consider implementing a policy to manage solicitation and distribution of information in the workplace for causes not related to work. This policy is meant to manage the solicitation and distribution of information by employees and outsiders, usually in a non-union environment, and to establish guidelines for compliance with the National Labor Relations Act (NLRA) in a non-discriminatory manner. A written and published policy also helps set the stage for an employer to defend against any unfair labor practice charges alleging that it discriminated against union supporters engaged in solicitation and distribution.
