  • An offer letter may be construed as an implied contract absent a statement that specifies the offer is not to be construed as a contract. See Making an Employment Offer.
  • Employers should exercise caution when making representations about compensation to prospective employees in order to minimize civil lawsuits for unjust enrichment. See Making an Employment Offer.
  • Medical testing may be conducted post-offer. However, the employer must provide the examiner with a written job description and copies of any relevant regulations. See Conditional Job Offers.
