Manage ADA and FMLA Leave Requests Checklist

When to Use

When an employee requests leave for a serious health condition or disability, HR must quickly assess legal obligations under both the Americans with Disabilities Act (ADA) and the Family and Medical Leave Act.

These laws provide different protections but often overlap. The FMLA provides up to 12 weeks of job-protected leave to eligible employees for qualifying reasons. The ADA is not a leave law per se, but leave can be considered a reasonable accommodation in appropriate circumstances. Use this checklist to identify obligations under each law and take action to ensure compliance with both.
