Health Information and Privacy Content Enhanced

The Health Information and Privacy (HIPAA) section of the Employment Law Manual has been updated to reflect the elimination of pre-existing condition exclusions, as required by the Affordable Care Act, effective for plan years beginning on or after January 1, 2014. In addition, state specific content relative to pre-existing condition requirements and pre-existing condition insurance plans was superseded by the Affordable Care Act requirements. As a result, there are no longer state specific requirements.
This content was also significantly enhanced to include expanded content on
- Excepted Benefits;
- Medical Privacy Under HIPAA;
- HIPAA's Security Rule; and
- The HIPAA Breach Notification Rule.
