Summary
- Wyoming employers enjoy a great deal of freedom to monitor employees without significant regulatory burdens.
- Employers may be subject to state criminal penalties for monitoring employee electronic communications. To avoid state prosecution, specific procedures must be put in place before employers may monitor electronic communications of employees in Wyoming. See Monitoring Electronic Communications.
- The Wyoming Fair Employment Practices Act (WFEPA) prohibits discrimination in hiring decisions based on age, sex, race, creed, color, national origin, ancestry, pregnancy or disability. The WFEPA restricts the type of interview inquiries and background checks that are permissible in Wyoming, as well as provides Wyoming workers with an avenue for filing claims of discrimination. - Employers may subject employees to physical exams prior to employment or at any time during employment. In certain circumstances, the employer is required to provide for an examination at its own expense. The release of information relative to such examinations is regulated by state law.
