Summary
- Vermont's Fair Employment Practices Act prohibits employers from retaliating against employees who complain about discrimination in the workplace. See Retaliation Under the Vermont Fair Employment Practices Act.
- Retaliation occurs when an employer discharges or otherwise discriminates against an employee because the employee has lodged a complaint or is about to lodge a complaint. See Retaliation Under the Vermont Fair Employment Practices Act.
- To prove a retaliation claim, an employee must show that:
- He or she was engaged in a protected activity;
- She or she was discharged or otherwise discriminated against; and
- There was a causal connection between the participation in the protected activity and the discriminatory act. See Establishing a Claim for Retaliation.
