Summary
- The Maine Military and Reserve Training Leave Law supplements the provisions of the federal law, The Uniformed Services Employment and Reemployment Act. See Employee Leaves > USERRA.
- Employees who are state military members, state Army and Air National Guard members or national reservists and employed in other than a temporary position may receive military leave. See Maine Military and Reserve Training Leave.
- Employers are not required to provide paid leave for employees who are on a military leave of absence. However, employers must continue health insurance and other benefits in effect for at least the first 30 days of the military leave of absence, with no cost to the employee. - Employers with 15 or more employees must also provide employees with 15 days per year of leave to the spouse, domestic partner, or parent of a member of the military called to active duty lasting more than 180 days. Such leave can be unpaid. See Maine Family Military Leave Law.
