When to Use
Employers must pay employees for any work they perform, whether "on the clock" or "off the clock." Off-the-clock work occurs when an employer knows or has reason to believe that an employee is continuing to work outside their scheduled shift to the employer's benefit, but the employer does not stop the employee from doing so. An employer may use this letter to solicit an employee's acknowledgement that they understand and will comply with an employer's timekeeping policy prohibiting off-the-clock work.
