Author: Michael C. Jacobson, Brightmine Legal Editor
The Workers' Compensation: Missouri content has been updated to reflect the passage of S.B. 1, a number of amendments to the existing workers' compensation regulatory laws, which go into effect on January 1, 2014.
Some of the highlights of the changes include:
- Employees must meet a new evidentiary threshold to recover for deaths or injuries that result from occupational diseases;
- "Occupational disease due to toxic exposure" is now limited to certain specific ailments;
- Employers cannot subrogate or replace employees in their lawsuits against third parties that caused or contributed to toxic work-related exposures;
- Workers' compensation insurers can demand reasonable medical examinations of employees; and
- Employers are permitted to partially self-insure against their workers' compensation liabilities.
