When to Use
Employers may occasionally be faced with the difficult task of terminating an employee who is out on FMLA leave due to performance issues, a company-wide reduction in force (RIF) or perhaps even due to FMLA leave abuse or fraud. In such cases, the employer should be careful to properly notify the employee of the termination of their employment and to do so in a timely manner. Using a letter, such as the one below, to notify an employee of their termination is advisable. Remember, the closer in time the reason for termination is to the receipt of the letter, the stronger the employer's case that the termination was proper.
